Purpose & scope
These terms govern the services provided by ELECTROTECH BY NM: electrical work, air-conditioning, heat pumps and refrigeration, plumbing, and the installation of electric-vehicle charging points (IRVE), for private and professional customers alike.
Quotation
Every service is covered by a free written quotation, valid for 30 days. The contract is formed on receipt of the signed quotation (marked “bon pour accord”), together with any deposit stated.
Prices
Prices are in euros, inclusive of VAT for private customers (at the rate in force). Any additional request made during the works is covered by a supplementary quotation.
Lead times
Completion times are stated in the quotation; they run from acceptance and, where applicable, from receipt of the deposit. Delays caused by force majeure or by the customer extend the lead time accordingly.
Right of withdrawal
For a contract concluded off-premises, consumer customers have 14 days to withdraw (art. L221-18 French Consumer Code), except for urgent maintenance or repair work expressly requested (art. L221-28). If performance is requested before the end of that period, the customer pays for the part already performed.
Payment
On receipt of invoice, unless an instalment schedule is set out in the quotation. Professional customers: late-payment interest at the ECB rate plus 10 points and a fixed recovery indemnity of €40 (art. L441-10 French Commercial Code).
Warranties
The customer benefits from the statutory warranties: conformity (art. L217-3 et seq. French Consumer Code), hidden defects (art. 1641 et seq. Civil Code) and, for building work, the one-year completion warranty, the two-year proper-functioning warranty and the ten-year structural warranty (art. 1792 et seq. Civil Code), covered by the company's professional insurance (certificate available on request).
Liability
The company cannot be held liable for damage resulting from abnormal use of the installations or from subsequent work carried out by a third party.
Consumer mediation
In accordance with art. L612-1 et seq. of the French Consumer Code, consumer customers may refer the matter free of charge to a mediator: (mediator and contact details to be completed by the publisher).
Governing law
French law applies. Failing an amicable settlement, the courts having jurisdiction over the registered office are competent (professional customers), or the statutory rules apply (consumers).
Only the French version is legally binding.
